AIBE 19 Question Paper Analysis: Key Takeaways

According to a thorough analysis of the question paper, the majority of the questions on the successfully completed AIBE 19 Exam 2024 were from the Constitutional Law parts. In all, 14 out of 100 questions were drawn from these sections. Then came the 12 questions on the Bharatiya Nagarik Suraksha Sanhita (BNSS), also known as the code of criminal procedure. There were ten questions in both the Criminal Law (Bharatiya Nyaya Sanhita) and the Law of Tort and Contract.

In addition to passage-based questions, the majority of the questions on the AIBE 19 question paper were connected to famous cases. In addition, the Bharatiya Nyaya Sanhita (BNS) and Bharatiya Ngararik Suraksha Sanhita (BNSS) were questioned rather than the Indian Penal Code and Code of Criminal Procedure. Additionally, some of the questions were directly derived from the Bare Acts. Compared to the other areas of the paper, the questions from the corporate law and labour law sections were a little more challenging.

Question 1: Aarti and Rajesh have been married for five years. Over time, Aaru has been subjected to continuous cruelty by Rajesh, which has led to emotional and mental distress. Aarti decides to file for divorces on the grounds of cruelty under Section 13(1)(1a) of the Hindu Marriage Act, 1955. Which of the following statements is true regarding the grounds for divorces under the Hindu Marriage Act?

(A) Aarti cannot seek divorces on the grounds of cruelty as it is not recognised under the Hindu Marriage Act

(B) Aarti must prove Rajesh's cruelty was intentional to succeed in the divorces petition

(C) Aarti can only seek divorces on the grounds of adultery.

(D) Aarti can seek divorces on the grounds of cruelty, as long as she proves mental or physical cruelty

Correct Answer: (D) Aarti can seek divorces on the grounds of cruelty, as long as she proves mental or physical cruelty.

Explanation: Under Section 13(1)(a) of the Hindu Marriage Act, 1955, cruelty—both physical and mental—is a valid ground for divorces. Aarti does not need to prove that the cruelty was intentional, only that it caused sufficient mental or physical distress to make cohabitation unreasonable.

Question 2: On matters where Dayabhaga is silent, what prevails?

(A) The Shrutis

(B) Mitakshara

Explanation: In the absence of specific guidance in Dayabhaga, local customs prevail. Hindu law recognises the importance of customs as long as they are not opposed to public policy or statutory provisions

Question 3: Nisha and Aakash are separated and they both seek custody of their minor child, Aarav. Nisha has been the primary caregiver, while Aakash claims that he can provide better financial stability for Aarav. They both approach the court under the Guardian and Wards Act, 1890. Which of the following factors will the court primarily consider in determining the custody of Aarav?

(A) The welfare and best interests of the child.

(B) The parent who is financially more stable is granted custody automatically.

(C) The financial stability of both parents.

(D) The gender of the child.

Correct Answer: (A) The welfare and best interests of the child.

Explanation: Under the Guardian and Wards Act, of 1890, the court’s primary consideration in determining custody is the welfare and best interests of the child. Factors like financial stability, the ability to provide a loving and secure environment, and the child's preference (if age-appropriate) are considered, but financial stability alone is not the deciding factor.
