The Bar Council of Karnataka was established under the Advocates Act, 1961. Like any other state bar council, the main task of the Bar Council of Karnataka is to enrol advocates and supervise legal professionals. The Karnataka State Bar Council (KSBC) was constituted as per the mandatory requirement as per Advocates Act, 1961 and Bar Council of India. The members of the Bar Council are elected from among members enrolled and practicing as lawyers in Karnataka and they represent the state in Bar Council of India meetings. To become an advocate in India, a law graduate has to clear the All India Bar Examination (AIBE). As per the AIBE eligibility criteria, a candidate must be enrolled with a state bar council before appearing for the AIBE exam. Once the candidate clears AIBE, they will be awarded a Certificate of Practice (COP). It must be noted that the AIBE exam is compulsory for candidates who obtained their law degree from 2009-10 onwards.

Validity of Enrolling With Bar Council of Karnataka for AIBE

The Bar Council of India (BCI) specifies that the AIBE is a post-enrolment exam. This means any candidate who wants to practise law in Karnataka needs to fill up the Bar Council of Karnataka registration form and enrol with it before appearing for AIBE.

The provisional enrolment is valid for two years on an undertaking by the candidate that they would clear the exam within two years from the date of enrolment. The Enrolment is also necessary for practising law.

The BCI further states that the time period of two years is valid only for practising law. However, the candidate can continue to take the AIBE exam as many times after the provisional enrolment, even beyond two years. This means the candidate can appear for the AIBE exam not just for two years but for any number of times till he or she clears the exam. However, the date of reckoning seniority would be considered from the date of the provisional enrolment.

Bar Council of Karnataka Eligibility Criteria

To enrol as an advocate, a candidate must have completed either a 3-year LLB or a 5-year LLB programme. As per the Bar Council of Karnataka eligibility criteria stated in the BCI rules 1999-2000, the authorities further state the following:

  • An applicant who was in service is required to submit a Study Certificate from the law college, if he/she has got admitted to LL.B. degree after 1998.

  • An applicant who is older than 40 years at the time of Enrolment is required to submit an affidavit on Rs. 20/-e- stamp paper in the prescribed format

How to Complete Bar Council of Karnataka Enrolment Registration?

In order to complete the Bar Council of Karnataka enrolment, candidates can apply online on the official website. The authorities also accept offline applications. However, before doing so, candidates must make sure they go through all the instructions and fulfil the Bar Council of Karnataka eligibility conditions.

  • Register by entering basic details such as mobile number and email ID to obtain login credentials.

In case of offline application, the candidates must download the Bar Council of Karnataka Enrolment form. They must then fill up the details and submit the application form in person at the office along with the required documents and application fee. The application must be submitted on or before Thursday of the week.

To successfully enrol in the State Bar Council of Karnataka, a candidate must pay the prescribed Karnataka Bar Council enrolment fees. The table given below provides the fee details of the Karnataka Bar Council enrolment fees.

What after the Bar Council of Karnataka Registration?

Upon successful submission of the application, the candidates would be notified about the date and time of appearing before the enrolment committee for interview and oath-taking ceremony.

Candidates would be required to appear before the enrolment committee either in person or through the Zoom platform. The candidate must be in full uniform when appearing before the committee.

Prescribed Dress Code When appearing before the Enrolment Committee

For Advocates other than Lady Advocates:

  • A black buttoned-up coat/ achkan/ chapkan/ black sherwani and white bands with advocate's gown,

  • A black open breast coat, white collar, stiff or soft, and white bands, along with advocate's gowns.

  • Long trousers (white, black, striped or grey) or dhoti.

Lady advocates:

  • Black coloured full or half-sleeve jacket or blouse in addition to a white collar, stiff or soft, and white bands with advocate's gowns.

  • Sarees or long skirts (white or black or any mellow colour without any print or design) or flares (white, black or black-striped or grey)

It must be noted that the wearing of an advocate's gown is optional except when appearing in the Supreme Court or in a High Court. Also, in court other than the Supreme Court, High Court, District Court, Sessions Court or City Civil Court, a black tie may be worn instead of bands

Rules to be followed during online Enrolment Procedure

  • The candidate must maintain decorum while appearing online for enrolment till end of the oath ceremony.

  • The video and audio must be switched on before entering into an online interview and wait for one’s turn. After the interview the candidate must exit from the screen.

  • Again, the candidate needs to log in for enrolment and oath taking ceremony at the given timings. At this time also, the audio and video must be switched on, and the face must be properly visible.

  • Candidates must be in proper uniform and must not be seen otherwise on the screen or adjusting the uniform in any way.

  • Candidates should not appear on the screen while eating, driving or doing other work or without a coat and band.

  • Candidates should not be accompanied by any other person and must appear alone on the screen.

  • If any of the above rules are not followed, the candidate’s enrolment will not be done and the candidate will be suspended.

After the successful completion of the enrolment procedure and ceremony, the Bar Council of Karnataka will send the enrolment certificate and ID card by post.

If you forgot to mention your booklet set code and other details on your AIBE 2024 exam OMR sheet while filling the rest of the information correctly, your exam may not be evaluated properly, and you could potentially face a delay in your results or even have your exam invalidated; however, there might still be a chance to rectify the situation.

Since AIBE exam is OMR based paper and is checked by using a specialized scanner called an "OMR scanner" which reads the darkened bubbles on the sheet, interpreting them as answers, and then comparing them to the answer key to generate a score - essentially, the machine "reads" the marks made on the paper to determine the correct answers, all through a process called Optical Mark Recognition (OMR). If it doesn't recognise your booklet code there are chances that it could not process your answer on code basis.

Reach out to the Bar Council of India (BCI) as soon as possible through their official website or helpline number. Explain the situation clearly, mentioning that you filled in all the details correctly except for the booklet set code and other missing information.

If possible, try to attach a scanned copy of your OMR sheet where you can highlight the correctly filled details and the missing booklet set code.

Using a whitener in the AIBE 19 exam (All India Bar Examination) is generally not allowed, as per the examination guidelines. However, if you used it in just one question and the rest of your answer sheet complies with the rules, the likelihood of outright rejection may be lower, but it ultimately depends on the discretion of the Bar Council of India (BCI).

Wait for Official Notification, Check your result once it is released, If the BCI invalidates your paper, they will usually notify you.

In some cases, minor infractions like using a whitener in a single question may not lead to disqualification, provided the rest of the answer sheet adheres to the rules. However, the final decision rests with the BCI.

Stay calm and wait for the official result or response from the authorities. Mistakes happen, and the best approach is to address them responsibly.
