The Bar Council of Gujarat (BCG) is an “Autonomous Statutory Body” constituted under the Advocates Act, 1961 with various powers, functions and duties. The Bar Council of Gujarat was formed on August 16, 1961 under the Advocates Act, 1961, the Gujarat Advocates’ Welfare Fund Act, 1991 and the rules framed by the Bar Council of India. According to Section 3 of the Advocates Act, the first elected body of the Bar Council of Gujarat took over the charge on December 6, 1961. In 1961, a total of 1184 advocates got enrolled with the State Bar Council, and gradually the number of members increased and as of now, approximately 75000 advocates are enrolled with the Bar Council of Gujarat.

To become an advocate in India, a law graduate has to clear the All India Bar Examination (AIBE). As per the AIBE eligibility criteria, a candidate must be enrolled with a state bar council before appearing for AIBE exam. Once the candidate clears AIBE exam, they will be awarded with Certificate of Practice (COP). The AIBE exam is compulsory for candidates who obtained their law degree from 2009-10 onwards.

Here are the functions of the Bar Council of Gujarat:

  • To admit persons as advocates on its roll

  • To prepare and maintain such roll

  • To entertain and determine cases of misconduct against advocates on its roll

  • To safeguard the rights, privileges and interests of advocates on its roll

  • To promote the growth of Bar Associations for the purposes of effective implementation of the welfare schemes referred to in clause (a) of sub-section (2) of this section and clause (a) of sub-section (2) of Section 7

  • To promote and support law reform

  • To conduct seminars and organise talks on legal topics by eminent jurists, and publish journals and papers of legal interest

  • To organise legal aid to the poor in the prescribed manner

  • To manage and invest the funds of the Bar Council

  • To provide for the election of its members

  • To visit and inspect Universities in accordance with the directions given under clause (i) of sub-section (1) of Section 7

  • To perform all other functions conferred on it by or under this Act

  • To do all other things necessary for discharging the aforesaid functions

To become an advocate and practice law in Gujarat, law graduates must register with the Bar Council of Gujarat after completing 5-year LLB or 3-year LLB programme.   • Download the enrollment form of the State Bar Council of Gujarat

  • Candidates can also purchase the registration from the Bar Council of Gujarat from the Bar Council office

  • Fill out the application or registration form for enrolment with the Bar Council of Gujarat

  • After filling in all details correctly in the enrollment form, sign in the place of "Signature of the Applicant."

  • Pay the enrolment fee through a bank challan

  • Submit the registration form to the office of the Bar Council of Gujarat, and you can submit it offline

No, a person cannot practice law in India without passing the All-India Bar Examination (AIBE). After completing an LLB degree from a recognized university, a law graduate must enroll with a State Bar Council and must clear the AIBE exam conducted by the Bar Council of India. Only after passing the exam, the advocate receives a Certificate of Practice , which allows him or her to practice law in any court in India.

So, without clearing AIBE, one cannot legally appear or argue in court.

Hello, Here is a clear and simple breakdown of who is eligible for the AIBE 20 (All India Bar Examination).

To be eligible for AIBE 20, you essentially need to have completed two main steps after your schooling:

  • You must have a 3-year LL.B degree or a 5-year integrated LL.B degree (like B.A. LL.B, B.Com LL.B, etc.). The most important part is that your degree must be from a college or university that is recognized by the Bar Council of India (BCI).
  • After you get your law degree, you cannot directly apply for the AIBE. You must first enroll as an Advocate with your respective State Bar Council. Once you enroll, you will get a unique enrollment number. This enrollment number is required to register for the AIBE 20 exam.

In short, the only people who can apply for AIBE 20 are those who have already graduated with a law degree and have also officially registered themselves as advocates with a State Bar Council.
