In the news: On October 16, 2026, the Supreme Court granted bail to former Rajasthan minister Mahesh Chandra Joshi and co-accused Mukesh. They are accused in the Jal Jeevan Mission scam. The case involves work orders worth Rs 979.45 crore.
A Bench of Justices Dipankar Datta and Sheel Nagu overturned the Rajasthan High Court's August 13 order denying bail. The investigation was complete, but the trial had not begun. The case involved 22 accused, 124 prosecution witnesses and 192 documents spanning around 20,000 pages. The Court held that the seriousness of allegations alone cannot justify prolonged detention before trial.
Article 21: Protects life and personal liberty. The Supreme Court has interpreted it to include the right to a speedy trial.
Key ruling: Prolonged pre-trial detention cannot become punishment before conviction. The gravity of the offence alone is not enough to deny bail indefinitely.
Bail and undertrial detention: Bail allows an accused to remain out of custody while the trial continues. Joshi and Pathak were granted bail subject to conditions, including restrictions on influencing witnesses or tampering with evidence.
Presumption of innocence: An accused is presumed innocent until proven guilty in court.
