    A closer look at the AIBE 21 result reveals that out of 79,739 LLB graduates who appeared in the exam, 35,287 failed to clear. Just over half cleared the exam as the pass rate stood at 55.75%. This raises serious questions about their ability to meet the minimum standards set by the Bar Council of India and practice law in courtrooms.

    This year, 1.75 lakh candidates appeared for open-book AIBE on June 7. Of these, 95,962 (54.5%) appeared under the undertaking category, comprising final-year LLB students.

    The overall pass rate was 65.91%. 59,876 candidates (34.08%) failed to pass the final filter before the courtrooms despite BCI lowering the cut-off by 3 marks. States such as Uttar Pradesh, Tamil Nadu and Odisha reported the highest pass rates, ranging from 76 to 78%. States such as Karnataka, Chhattisgarh, and Gujarat reported the highest failure rates, ranging from 68 to 66%.

    LLB graduates constitute just 38% of the total qualified candidates

    Among the total qualified candidates, the share of LLB graduates is only 38.4%. The LLB graduates, while constituting 45% of everyone who appeared, accounted for nearly 59% of everyone who failed. Removing the undertaking students drags the pass rate down from 65% to just 56%.

    Broader Context: Is the quality of LLB graduates declining?

    According to the BCI, AIBE intends to improve the standards of the legal profession. It is conducted to assess the basic level of knowledge of candidates. An initial review of the question paper also establishes that it is not an in-depth law examination. LLM entrance exams, such as CLAT PG or AILET PG, are widely accepted as having greater difficulty than AIBE.

    The high failure rate in AIBE provides a reality check. It raises questions about whether law schools in India are producing LLB graduates who can meet the minimum benchmarks and critical thinking for entering the legal profession. Nearly 1 in 2 just failed to meet the current standards, which decide who can call themselves an advocate.

    Why a high failure rate?

    AIBE results warrant an investigation into the quality of law schools in India. Indian law schools are often grouped in multiple tiers. National Law Universities and a handful of private law schools create a top league that is entirely different from the remaining 1,500+ law schools. The divide in academic standards and student quality is significant. While the top law schools have maintained higher academic standards, many law schools face faculty and infrastructure shortages and inconsistent academic quality.

    Another possible reason is that LLB graduates have been treating AIBE as an ‘easy to pass’ exam. An open-book exam where the candidate is allowed to take Bare Acts with short notes creates a perception of an easy walkway.

    Additionally, several law graduates who do not take AIBE immediately after completing their graduation risk losing touch with their studies. AIBE requires them to go through the basics of law again from scratch.
